What Is a Lien Waiver?
A lien waiver is a document from a contractor, subcontractor, or supplier that waives their right to file a mechanics lien against a property. It is exchanged for payment. Lien waivers protect property owners and general contractors by confirming that everyone in the payment chain has been paid for their work.
The 4 Types of Lien Waivers
Used during construction for progress payments. The waiver is conditional -- it only takes effect once payment actually clears. This is the safest option for contractors because if the check bounces, the waiver is void and your lien rights remain intact.
Also used for progress payments, but takes effect immediately upon signing, regardless of whether payment has been received. Only sign this after you have confirmed the money is in your account. Once signed, you cannot take it back.
Used at the end of a project with the final payment. Like the conditional progress waiver, it only takes effect once the final payment clears. It protects you in case the last check does not clear.
The most powerful waiver. It permanently and immediately waives all lien rights on the entire project. Only sign this after all payments have been fully received and verified. There is no undo.
